Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ember. By creating an account or using the service, you agree to be bound by these Terms.

This document is a starting template. Have it reviewed by a qualified lawyer before launch.

Your account

  • You must be at least 18 years old and capable of forming a binding contract.
  • You're responsible for activity under your account and for keeping your password safe.
  • One person or legal entity per account, unless otherwise agreed.

Acceptable use

You agree to use Ember only for lawful business outreach. You may not use Ember to send unsolicited messages that violate applicable anti-spam laws (including GDPR, PECR, CAN-SPAM, CASL), to harass, mislead, or harm recipients, or to circumvent the safety features described in our Acceptable Use Policy.

Connected inboxes

When you connect Gmail or Outlook, you authorise Ember to send campaigns you've explicitly approved from your inbox. You can revoke this access at any time from Settings or from your email provider.

Plans, billing & cancellation

  • Paid plans are billed monthly in advance. Prices are listed in GBP and exclude applicable taxes unless stated.
  • You can cancel at any time from your billing portal; access continues until the end of the billing period.
  • We don't offer refunds for partial periods unless required by law.

Content & ownership

You own the businesses, drafts, and messages you create in Ember. You grant us a limited licence to host and process them solely to operate the service. We own the Ember product, branding, and underlying technology.

Termination

We may suspend or terminate your access if you violate these Terms, abuse the service, or put recipients, infrastructure, or other users at risk. You may close your account at any time.

Disclaimers

The service is provided "as is". We do not warrant uninterrupted operation, deliverability of any individual email, or fitness for a particular purpose. To the maximum extent permitted by law, our liability is limited to the fees you paid in the three months preceding the claim.

Governing law

These Terms are governed by the laws of England & Wales. Disputes will be resolved in the courts of London, unless mandatory consumer protection laws apply.

Changes

We may update these Terms from time to time. We'll notify you of material changes by email or in-app.
